ChongCheck — DMCA & Intellectual Property Policy

ChongCheck OÜ ("ChongCheck", "we") respects the intellectual-property rights of others. This Policy explains how to report alleged copyright infringement under the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and parallel notice-and-takedown procedures in other jurisdictions (EU Copyright Directive 2019/790, UK CDPA 1988, Russian Federation Civil Code Part IV).

It supplements our Terms of Service and Acceptable Use Policy.

1. Designated Agent

Email is the preferred method. We confirm receipt within 2 business days. The agent's contact information is also registered with the U.S. Copyright Office at www.copyright.gov/dmca-directory.

2. How to Submit a DMCA Notice

To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

1. A physical or electronic signature of the owner (or person authorized to act on behalf of the owner) of the exclusive right being infringed;
2. Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works);
3. Identification of the allegedly infringing material, including the URL or other location on the Service where it appears (be specific enough that we can locate it);
4. Your contact information — full name, mailing address, telephone number, and email address;
5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on behalf of the owner.

Warning. Submitting a knowingly false notice may result in liability for damages, costs, and attorney's fees under 17 U.S.C. § 512(f). Please be sure of the facts before submitting.

3. Our Response

Upon receiving a complete notice, we will:

1. Acknowledge within 2 business days;
2. Review the notice for completeness and apparent good faith;
3. If valid, remove or disable access to the allegedly infringing material expeditiously;
4. Notify the user who submitted the material, with a copy of the notice (redacted of your home address if you request);
5. Allow the user to submit a counter-notice (Section 4).

We may decline notices that are facially deficient, abusive, or appear submitted in bad faith.

4. Counter-Notification

If you believe material you submitted was removed in error, you may submit a counter-notice. To be effective under 17 U.S.C. § 512(g)(3), your counter-notice must include:

1. Your physical or electronic signature;
2. Identification of the material that was removed and its location prior to removal;
3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification;
4. Your name, mailing address, telephone number, email;
5. A statement that you consent to the jurisdiction of the federal district court for the district where your address is located (or, if outside the U.S., the federal district court for any district in which ChongCheck may be found) and that you will accept service of process from the original complainant.

Upon receipt, we will forward the counter-notice to the original complainant and restore the material in 10-14 business days, unless the complainant gives notice that they have filed a court action seeking a restraining order against the user.

5. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), we maintain a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We track DMCA notices on a per-account basis. Generally:

• One valid notice → warning;
• Two valid notices in 12 months → temporary suspension;
• Three valid notices in 12 months → permanent termination of account, with cooperation with rights-holders as required.

Counter-notices that result in restoration do not count toward this tally.

6. Non-U.S. Jurisdictions

6.1 European Union (Article 17 of Directive 2019/790)

For users and rights-holders in the EU, we operate a notice-and-action mechanism aligned with Article 17. Submit notices to the same DMCA Agent contact. Counter-notification and out-of-court dispute resolution are available; we may refer disputes to a designated alternative dispute-resolution body in the rights-holder's or user's Member State.

6.2 United Kingdom (CDPA 1988, e-Commerce Regulations 2002)

Submit notices to the DMCA Agent. We act expeditiously to remove material identified as infringing upon receiving sufficient information.

6.3 Russian Federation (Civil Code Part IV; Federal Law 149-FZ Article 15.7)

Submit notices to dmca@chongcheck.app. Notices must include translated documents demonstrating the rights-holder's title and the specific URL of the allegedly infringing material. We respond within the statutory 24-hour acknowledgment / 72-hour action window.

6.4 Other jurisdictions

Where local law provides for a specific notice mechanism (e.g., Japan, Australia, Brazil), we honour the procedure required by that law. Submit notices to the DMCA Agent in English or in the local language with an English summary.

7. Trademark Infringement

To report unauthorized use of a trademark on the Service:

• Email: trademark@chongcheck.app
• Include: trademark registration number and jurisdiction, identification of the allegedly infringing use (URL/location), contact information, and a statement of good-faith belief similar to the DMCA standard.

We treat trademark notices with the same care and timeliness as copyright notices.

8. Patent Notices

We do not have an in-Service mechanism for patent disputes. Submit patent-infringement claims through written correspondence to legal@chongcheck.app. We will respond after legal review.

9. Our Own Intellectual Property

The Service — including its source code, prompts, model weights (where proprietary), training-data labels, documentation, design system, copy, and brand assets — is the intellectual property of ChongCheck or its licensors. Unauthorized reproduction, distribution, or commercial use is prohibited and may be enforced through DMCA, trademark, and other legal mechanisms in any jurisdiction.

If you believe ChongCheck has used your IP without authorization, please contact legal@chongcheck.app so we can investigate.

10. Limitation

This Policy does not waive any rights or remedies available to ChongCheck under applicable law. We reserve the right to remove or disable any content for any reason consistent with our Acceptable Use Policy and applicable law.
